  2. EASEMENT AGREEMENT

  4. Katherine Parkinson, referred to as OWNER, and Florence Ferguson,
  5. referred to as GRANTEE,  agree:

  7. OWNER is the owner in fee simple of the following described real 
  8. estate:

  10. see attached legal description, exhibit 1 
  11.  
  12. GRANTEE is the owner in fee simple of the following described 
  13. real estate: 
  14. see attached legal description, exhibit 2 
  15.  
  16. In consideration of $ 17,500.00 ( seventeen thousand five hundred
  17. & no/100 dollars) paid by GRANTEE, the  OWNER grants to GRANTEE
  18. the following easement: 
  19.  
  20. an easement and right of way for the purpose of exercising within
  21. such easement including improving, constructing, fencing,
  22. maintaining, repairing, operating and using, channels, banks,
  23. levees, storm drains and using the same on the following portion
  24. of said real estate:

  26. see attached legal description, exhibit 3 
  27.  
  28. Further, the OWNER agrees to the following restrictions on the 
  29. future use and enjoyment of OWNER's real property: 
  30.  
  31. no structures, vegetation or other objects will be allowed to 
  32. encroach within the easement stated above.

  34. The grant of easement herein shall bind the heirs and assigns of 
  35. the OWNER and GRANTEE. The rights herein shall be specifically 
  36. enforceable.
